Terms of Service

1. Agreement
By accessing or using SharkHost services, you agree to these Terms of Service, our Acceptable Use Policy (AUP), Privacy Policy, Refund Policy, and any other related documents (collectively, the “Agreement”). Continued use after any updates constitutes acceptance.

2. Services Provided
SharkHost provides:

  • Dedicated servers (unmanaged unless explicitly stated)
  • VPS and Cloud Instances
  • Managed services (if purchased)
All services are provided “as-is” unless an SLA explicitly states otherwise.

3. Customer Responsibility
You are responsible for:

  • Security and maintenance of all software, applications, and data
  • Compliance with local, state, and federal laws
  • Backups and data retention
  • Ensuring usage complies with the Acceptable Use Policy

4. Suspension & Termination
SharkHost may suspend or terminate services immediately if:

  • You violate the AUP
  • Your services are used for illegal activity
  • Abuse complaints are received
  • Payments are declined or chargebacks occur
No refunds are issued for services terminated due to violations or abuse.

5. Limitation of Liability
SharkHost is not liable for indirect, incidental, special, punitive, or consequential damages. Maximum liability is limited to the total amount paid by the customer for the affected service in the 30 days preceding a claim.

6. Indemnification
You agree to indemnify and hold harmless SharkHost, its officers, employees, and affiliates from any claims, damages, or legal actions arising from your use of the services, violation of these terms, or infringement of third-party rights.

7. Governing Law
These terms are governed by the laws of California, USA. Any disputes will be resolved exclusively in the courts located in Los Angeles, California.

8. Changes to Terms
SharkHost may update these terms with notice. Continued use after updates constitutes acceptance.

Acceptable Use Policy

1. Prohibited Activities
You may not use SharkHost services to:

  • Send spam, phishing emails, or other unsolicited communications
  • Host malware, ransomware, or illegal content
  • Launch DDoS attacks or participate in network attacks
  • Operate botnets, TOR exit nodes, or anonymization services without prior approval
  • Violate copyright, trademark, or other intellectual property laws
  • Engage in unauthorized port scanning, IP spoofing, or network attacks
  • Abuse system resources beyond fair usage

2. Enforcement
SharkHost may:

  • Temporarily suspend services immediately upon detecting violations
  • Terminate accounts for repeated or severe abuse
  • Cooperate with law enforcement or other authorities as required

3. Fair Usage
Services are for legitimate business, personal, or development purposes. Excessive resource consumption may result in throttling, suspension, or termination.

4. Updates
SharkHost may modify this policy to respond to new threats. Continued use constitutes acceptance.

Privacy Policy

1. Information Collection
SharkHost collects:

  • Account information (name, email, billing details)
  • Usage data (IP addresses, server logs, monitoring data)
  • Support communications

2. Data Usage
Collected data is used for:

  • Service delivery and support
  • Billing and fraud prevention
  • Compliance with legal obligations

3. Data Sharing
SharkHost does not sell or trade personal data. Disclosure occurs only if legally required.

4. Data Retention
Logs and personal info are retained while your account is active. Accounts deleted by users will have data purged after a reasonable retention period.

5. Security
Reasonable technical measures are in place to protect data. Customers are responsible for securing passwords and access.

6. Cookies & Tracking
Cookies are used for session management, analytics, and optional marketing. By using the site, you consent to cookies.

Abuse & Refund Policy

Abuse Reporting
Open a ticket with our Abuse department here with server IP, evidence, and description. SharkHost investigates within 24 hours.

Resolution
Temporary suspension may occur immediately. Repeated violations result in termination. Legal action may be taken for criminal activity.

Refund & Billing

  • Refunds are discretionary within the first 3 days for new services (excluding dedicated servers after provisioning, addons, and domains)
  • No refunds are issued for terminated accounts due to abuse
  • Chargebacks or payment disputes may restrict future payment methods
